Kitty Hawk site eyed for housing project sold to MTS Capital Holdings, LLC, little known about newly formed group

In a May 30 transaction, Kitty Hawk Estates, LLC sold 42 parcels of property, a site that had been eyed as a location for workforce/affordable housing, to MTS Capital Holdings, LLC for $2.1 million, according to county records.

Kenneth P. Whichard of Greenville is listed as a member/manager for Kitty Hawk Estates, LLC on the deed. But to date, the identities of the principals of the MTS Capital Holdings group have not been disclosed.

At one point, the Kitty Hawk Estates property in that town—described in the deed as “Kitty Hawk Estates, Sea Scape Section 3, Kitty Hawks Woods”—was under consideration as the possible site for a housing project to be developed by Coastal Affordable Housing, LLC, which was, at that time, a partner with Dare County in its efforts to build more workforce housing.

One of the principals of Coastal Affordable Housing (CAH) LLC is Jordan Hennessy, a former aide to State Senator Bill Cook, an officer at EJE Dredging, which owns and operates the Miss Katie Dredge and a member of the Coastal Resources Commission.

According to an April story in the Virginian-Pilot, CAH invoices submitted to the county indicated that Hennessy “signed an agreement with Albemarle & Associates, Ltd., on behalf of Coastal Affordable Housing on May 5, 2023, for ‘land use consultations/rezoning regarding properties owned by Kitty Hawk Estates, LLC.” The story also reported that in February 2023, CAH paid $25,000 to Kitty Hawk Estates, LLC in what was called a “holding fee.”

But on April 9, the Dare County Commissioners, expressing frustration with the challenges of getting new housing projects built, announced they were ending the county’s partnership with CAH and planning to return the $35 million in state funds that CAH would have been able to use for those housing projects.

The documents on file with the North Carolina Secretary of State’s Office, show that MTS Capital Holding, filed Articles on Organization on April 2, exactly one week before the Dare Commissioners made the announcement about ending the relationship with CAH. The address of the principal office of MTS is 82 Patton Avenue in Asheville, NC.

However, at this point, the identities of the officers of the LLC appear to be closely guarded. The attorney listed as representing MTS in the filing of the deed has not returned Voice messages. The attorney listed as the registered agent for the LLC that is listed as the registered agent for MTS Capital Holdings, did not respond to messages. The Voice did reach the attorney listed as the Organizer on the MTS Articles of Organization, Steven B. Long.

Long stated that he is not authorized to discuss the individuals in the MTS group, but said he passed messages along to someone who is authorized to speak. There has been no response from that individual.

One way more information about MTS would become available is if and when the organization comes before the Town of Kitty Hawk seeking permits and approvals for work to be done on the site. As of this week, Kitty Hawk Town Manager Melody Clopton said no one from MTS Capital Holding has approached town officials.


Barnhill Building Group has been selected as the Construction Manager @ Risk by the College of the Albemarle and is seeking to pre-qualify construction trade contractors to submit bids for the furnishing labor, materials, equipment, and tools for the new College of The Albemarle – Allied Health Sciences Simulation Lab (COA Health Sciences) located in Elizabeth City, NC. The project consists of the new construction of a 38,000-sf, 2-story expansion to the existing Owens Health Sciences Center and will house classrooms, labs, and a simulation lab. The site is just over just over 4.5 acres and is located on an active campus. This new construction will be a steel structure with a brick and metal panel veneer, curtainwall, and storefront glazing with a PVC roof membrane.

    The address of the principal office of MTS is 82 Patton Avenue in Asheville, NC. This is the address for Ward and Smith, P.A., Suite 300. Ward and Smith is an attorney for Coastal Affordable Housing, see previous Voice articles. There are reimbursement clauses in the agreements between the County and Coastal Affordable.

    Was the earlier $25K Coastal paid the previous owner of this parcel using County money reimbursed?

    Did the County provide payment for the reimbursement that Coastal submitted?

    How much has been paid to Coastal?

    Is there any ongoing communication/litigation between the County and Coastal.

    The County is going to work hard to suppress this information until after the election. A one on one sit down with Chairman Woodard would be interesting if he were asked these questions. Or he could be ‘transparent’ and address them.

    Who is MTS Capital Holding? Why it’s Kitty Hawk Estates, LLC, under a different name. And so it goes round and round in the age old corporate shell game.

    So is the issue the affordable housing or the land on where the potential housing is to take root?

    Affordable housing is predicated upon what is interpreted as affordable housing and whom it is affordable to.

    The land is all zoned and coded and t’s crossed and i’s dotted. If its not “affordable” housing then is it “unaffordable” housing(out of my price range)?

    Are we trying to preserve something here? The unofficial OBX interpretation of what Dare County is supposed to be as opposed to what it actually is – A well funded tax base that generates millions of dollars in revenue on a narrow strip of land that still has the potential for more streams of tax generated revenue

    This land is zoned low density residential. And I believe it to be wetlands. Questionable that Kitty Hawk will approve this change in zoning or a variance or the fact that it is wetlands, as I suspect.

    Another mysterious LLC… Who are they?…LLC’s are a tax and accountability mechanism to protect the assests of the group or person forming it.. (look at all the “single familiy resident 20+ room megamansions and see how many are owned by LLC’s)..If whoever is behing this LLC wants to gain support from the community the first thing is to be open and upfront.. and to start they should say who makes up this group..
